Terms of Service

These Terms of Service ("Terms") govern your access to and use of Wepost, a content-scheduling feature operated by Wefluence ("Wefluence", "we", "us", or "our"). By accessing or using Wepost, you agree to be bound by these Terms. If you do not agree, do not use the service.

1. The Service

Wepost lets you schedule and automatically publish content (photos, videos, and captions) to social media accounts you connect, such as Instagram and TikTok, at times you choose. Features may change, be added, or be removed over time.

2. Eligibility

You must be at least 13 years old (or the minimum legal age in your jurisdiction) and capable of forming a binding contract. You are responsible for ensuring your use complies with all laws applicable to you.

3. Account & Connected Platforms

You must connect a valid social account that you own or are authorized to manage.
You are responsible for maintaining the confidentiality and security of your credentials and connected accounts.
Your use of Instagram, TikTok, and other connected platforms is also subject to those platforms' own terms and policies. You agree to comply with them.

4. Your Content

Ownership. You retain all ownership rights to the content you upload.
License. You grant us a limited, non-exclusive license to store, process, and transmit your content solely for the purpose of scheduling and publishing it to your connected accounts as you direct.
Responsibility. You are solely responsible for your content and confirm you have all necessary rights to publish it.

5. Acceptable Use

You agree not to use Wepost to:

Post content that is illegal, infringing, deceptive, harassing, hateful, or otherwise harmful;
Send spam or violate the terms, policies, or rate limits of any connected platform;
Infringe intellectual property or privacy rights of others;
Interfere with, disrupt, or attempt to gain unauthorized access to the service or its systems.

6. Third-Party Platforms

Wepost relies on third-party APIs (e.g., Meta/Instagram, TikTok). We do not control those platforms and are not responsible for their availability, changes, rejections, removals, or actions taken on your accounts. Publishing may fail or be delayed due to platform issues, quotas, expired tokens, policy enforcement, or connectivity beyond our control.

7. Service Availability

We strive to deliver scheduled posts on time but do not guarantee uninterrupted, error-free, or timely operation. The service is provided on a best-effort basis and may be modified, suspended, or discontinued at any time.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT POSTS WILL ALWAYS PUBLISH SUCCESSFULLY OR ON TIME.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WEFLUENCE AND ITS AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR REACH, ARISING FROM OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE SERVICE, INCLUDING FAILED, DELAYED, OR INCORRECT POSTS. OUR TOTAL AGGREGATE LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US (IF ANY) FOR THE SERVICE IN THE 3 MONTHS PRECEDING THE CLAIM.

10. Indemnification

You agree to indemnify and hold harmless Wefluence and its affiliates from any claims, damages, liabilities, and expenses arising out of your content, your use of the service, or your violation of these Terms or any third-party rights or platform policies.

11. Termination

We may suspend or terminate your access at any time if you violate these Terms or any connected platform's policies, or to protect the service or other users. You may stop using the service and disconnect your accounts at any time.

12. Governing Law

These Terms are governed by the laws of the Republic of Indonesia, without regard to conflict-of-law principles. Any disputes shall be subject to the competent courts located in Indonesia, unless otherwise required by applicable law.

13. Changes to These Terms

We may update these Terms from time to time. The latest version will always be available on this page with a revised date. Continued use after changes take effect constitutes acceptance.
